Terms of Service

1. Acceptance of Terms

By accessing or using CreatorNode ("Service"), you ("User", "You") agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the Service.

If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.

2. Description of Service

CreatorNode is an API platform for content creators and their AI agents. The Service provides various APIs that offer analysis, rendering, and AI-powered tools accessible via HTTPS.

The Service is provided "as is".

3. API Access and Authentication

3.1 API Keys

  • Some public Service endpoints are available without an API key under the free tier, subject to stricter rate limits, lower usage ceilings, and feature restrictions
  • Paid tiers and higher limits require a valid API key
  • API keys are personal and non-transferable
  • You are responsible for maintaining the security of your API key
  • Compromised keys must be reported immediately

3.2 Account Tiers

The Service is available in multiple tiers with different rate limits and features. Current tiers, pricing, and credit packages are listed at creatornode.io/pricing. Rate limits and pricing are subject to change with reasonable notice.

4. Acceptable Use

4.1 You MAY:

  • Use the Service for legitimate content creation and optimization purposes
  • Integrate the API into your applications
  • Cache results for reasonable periods
  • Use results commercially

4.2 You MAY NOT:

  • Reverse engineer the scoring algorithms
  • Resell API access without authorization
  • Submit illegal, harmful, or copyrighted content you don't own
  • Attempt to circumvent rate limits or authentication
  • Use the Service for competitive analysis of the Service itself
  • Overload, disrupt, or attack the Service infrastructure
  • Use automated systems to create multiple free accounts

4.3 Content Restrictions

You warrant that all content submitted to the Service:

  • Is owned by you or you have the rights to process it
  • Does not contain illegal content
  • Does not violate third-party rights

5. Intellectual Property

5.1 Our IP

The Service, including algorithms, APIs, documentation, and branding, is owned by CreatorNode. These Terms do not grant you any rights to our intellectual property except the limited license to use the Service.

5.2 Your Content

You retain ownership of all content you submit. By using the Service, you grant us a limited, non-exclusive license to process your content solely to provide the Service.

5.3 Results

Analysis results provided by the Service may be used by you without restriction for your own purposes.

6. Data Handling

We process only the data necessary to provide the Service. Submitted content is not stored permanently unless caching is enabled. See our Privacy Policy for complete details on data collection, retention, and your rights.

7. Service Level

7.1 Availability

We target 99.5% uptime but do not guarantee uninterrupted service. Scheduled maintenance will be announced when possible.

7.2 Support

  • Free tier: Community support only
  • Premium tier (prepaid): Priority email support (24h response)
  • Enterprise tier: Dedicated support with SLA

7.3 Changes to Service

We may modify, suspend, or discontinue any part of the Service with reasonable notice. Material changes will be communicated via email to registered users.

8. Fees and Payment

8.1 Pricing

Current pricing is available at creatornode.io/pricing. Prices are subject to change at any time without prior notice. No price guarantees or price-lock commitments are provided under any self-service plan. Enterprise customers with a signed contract are governed solely by the pricing terms specified in that contract.

8.2 Merchant of Record

All payments are processed by Paddle (paddle.com), which acts as the Merchant of Record. Paddle handles billing, taxes, invoicing, and refund enforcement on our behalf.

8.3 Prepaid Credits

  • Prepaid credits are non-refundable
  • Credits expire 12 months after purchase
  • Unused credits are forfeited upon account termination

8.4 Digital Content with Immediate Access

CreatorNode API credits are digital goods delivered with immediate access. When you complete a purchase, you receive an API key loaded with credits that can be used immediately.

8.5 Refund Rights

Your refund rights are determined by the consumer protection laws of your jurisdiction and are enforced automatically by Paddle during the checkout process. In most jurisdictions — including the European Union (Directive 2011/83/EU, Article 16(m)) — your right to withdraw from the purchase is waived once you consent to immediate access to the digital content. This consent is collected by Paddle at checkout.

Because you receive immediate access to digital content upon purchase, a right to a refund typically does not arise. If you experience a technical issue preventing you from using the Service, contact support@creatornode.io.

8.6 Overages

Requests exceeding your tier limits will be rejected (HTTP 429). No overage charges apply.

9. Disclaimers

9.1 No Warranty

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

9.2 Analysis Accuracy

  • All rankings and analyses are algorithmic suggestions, not guarantees of performance
  • AI-generated content is for guidance only
  • We do not guarantee improved performance on any platform
  • Results may vary based on content, audience, and platform changes

9.3 Third-Party Services

The Service uses third-party providers (Azure, OpenAI). We are not responsible for their availability or performance.

10. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • WE ARE NOT LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES
  • OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID US IN THE 12 MONTHS PRECEDING THE CLAIM
  • FOR FREE TIER USERS, OUR LIABILITY IS LIMITED TO $0

This limitation applies regardless of the theory of liability (contract, tort, or otherwise).

11. Indemnification

You agree to indemnify and hold harmless CreatorNode, its officers, employees, and agents from any claims, damages, or expenses arising from:

  • Your use of the Service
  • Your violation of these Terms
  • Your violation of any third-party rights
  • Content you submit to the Service

12. Termination

12.1 By You

You may stop using the Service at any time. To delete your API key, contact support.

12.2 By Us

We may suspend or terminate your access if you:

  • Violate these Terms
  • Engage in abusive behavior
  • Fail to pay applicable fees
  • Create risk or legal exposure for us

12.3 Effect of Termination

Upon termination:

  • Your API key will be revoked
  • Unused prepaid credits are forfeited
  • We may delete your cached data
  • Provisions that should survive (IP, liability, indemnification) will survive

13. Governing Law and Disputes

13.1 Governing Law

These Terms are governed by the laws of the Czech Republic, without regard to conflict of law principles.

13.2 Dispute Resolution

Any disputes shall be resolved through:

  1. Good faith negotiation (30 days)
  2. Mediation if negotiation fails
  3. Courts of the Czech Republic as final venue

13.3 Class Action Waiver

You agree to resolve disputes individually and waive any right to participate in class actions.

14. General Provisions

14.1 Entire Agreement

These Terms constitute the entire agreement between you and CreatorNode regarding the Service.

14.2 Severability

If any provision is found unenforceable, the remaining provisions remain in effect.

14.3 No Waiver

Our failure to enforce any right does not waive that right.

14.4 Assignment

You may not assign these Terms. We may assign them in connection with a merger or acquisition.

14.5 Modifications

We may modify these Terms by posting updated terms. Continued use after changes constitutes acceptance.
